Reporting and Investigation

The criminal justice system’s response to a sexual assault begins once law enforcement receives a report that the crime has been committed. Law enforcement will conduct an investigation and decide whether to refer the case to the prosecutor’s office. Ultimately it is the prosecutor’s decision to determine whether, and which, charges to file. Following is a brief overview of the ways law enforcement receives reports of sexual assault and how evidence is gathered at the investigation stage.
