Limitations to Right to be Present
It is important to understand that, even where crime victims have a right to be present, this right cannot infringe on a criminal defendant’s right to a fair trial. In many local practices, this means that a crime victim will not be permitted to attend portions of hearings and/or trial during which other witnesses or evidence are being presented. The rationale is that the victim’s testimony could be affected or altered, whether intentionally or unintentionally, by hearing the testimony and evidence offered by other witnesses.
