This case resulted in a landmark decision holding that welfare recipients who are required to work in exchange for receiving their welfare benefits are employees who are protected by Title VII of the Civil Rights Act of 1964, the federal law that prohibits employment discrimination. In February 2004, the Second Circuit Court of Appeals ruled in a 2-1 decision that workfare employees are protected by Title VII. Subsequently the parties reached a settlement providing prospective relief to all New York City workfare participants and a significant financial award to each of our clients.
