Module 6
Considerations for Advocacy on Behalf of Victims from Vulnerable Populations

Protections for Immigrant Victims

The federal Violence Against Women Act and Trafficking and Violence Protection Act provide protections for immigrant victims and their close family members. U-Visas give legal status to immigrant victims of serious crimes, including sexual assault, and T-Visas are available to victims of human trafficking. Generally, victims must have reported these crimes to law enforcement and cooperated with the investigation and any ensuing criminal charges. A certification of such from a qualified agency will be required.

The Immigrant Legal Resource Center has a chart outlining the differences between these programs and requirements for each, available at https://www.ilrc.org/sites/default/files/resources/comparative_chart_7.5.17_finalv2.pdf.1
